The circular no. 2007/27 of the Undersecretariat of Treasury has enabled the parties to issue a record between themselves by reaching an agreement only for the accidents ended with “material damage” as of April 1, 2008.
Such records are used by implementing the predetermined process steps for the case, and the ratios of fault of the vehicle drivers, who were involved in the accident, in the occurrence of accident are determined.

In case of driving a motorized vehicle without driver’s license or driving a motorized vehicle with improper driver’s license,
If the driver’s age is small,
If the driver has consumed alcohol or there is any doubt about his/her mental health,
If one or more of the vehicles involved in the accident do(es) belong to public entities,
If any damage occurs in the properties of public entities,
If only the properties of third persons are damaged in a traffic accident,
If one or more of the vehicles involved in the accident do(es) not have traffic insurance,
If the traffic accident has resulted in a death and/or injury.
Following issues must be taken into consideration when preparing “Report for Traffic Accident with Material Damage”.
To the extent possible, photographs must be taken from different angles before removing the vehicles from the accident site.
Original signatures of all vehicle drivers involved in the accident must be available on the report.
All fields in the report must be fully completed.
The way of occurrence of the accident must be written legibly and in an explanatory way by the persons involved in the accident and it must be supported with a sketch.
More than one form can be used in accidents involving more than two vehicles. The form can be photocopied.
Photocopies of licenses of vehicles involved in the accident and photocopies of driver’s licenses must be obtained.
Details of “Compulsory Traffic Insurance” policies of the vehicles must be completely and legibly written. It must be ensured that the details written on the report belong to the traffic policy and do not belong to the policies of a car insurance, etc.
Ratios of faults of drivers involved in the accident are determined within 3 days after the report is received by relevant insurance companies and entered in Tramer system by those companies.
Ratios of fault are 0%, 50%, and 100% and no other ratio is allowed to be used.

Pursuant to the Circular No. 2007/27, dated December 28, 2007, published by the Undersecretariat of Treasury for Accident Reports to be Completed by the Parties in Traffic Accidents with Only Material Damage, the applicable procedure is as given below.
In case of traffic accidents causing material damage only, if the parties reach an agreement on the report to be completed by them regarding the way of occurrence of accident, the report will be prepared in accordance with the below principles according to Highway Traffic Law No. 2918.
1. The parties complete and sign “The Report for Traffic Accident with Material Damage” (Report), attached to the circular in accordance with the explanations attached thereto.
2. The reports will not be deemed valid unless they are signed by all parties involved in the accident.
3. More than one form can be used in case of traffic accidents, to which more than one vehicle is involved, or if it is deemed necessary. Such issued reports can be photocopied.
5. Such reports are valid like Traffic Accident Reports issued by traffic police.
6. When preparing the report, photos of vehicles are taken, if possible, before removing the vehicles from the accident site and photos are evaluated together with the report.
7. Beneficiaries will apply to the insurance company, which has issued the Highways Compulsory Financial Liability Insurance (Traffic Insurance) policy of counter party or the car insurance policy of their own vehicles, together with the report that they have completed in accordance with the above article and, if any, with the photos.
8. The applied insurance company submits the report and photos, if any, by electronic means to Traffic Insurances Information Center (TRAMER) until the end of next business day.
9. TRAMER submits such report and photos, if any, by electronic means to the insurance companies that have issued the traffic insurance and car insurance of the relevant vehicles until the end of next business day.
10. Insurance companies evaluate the responsibilities in the accident, based on the ratios of 0%, 50% and 100%, by taking the accident sketches attached to the circular into consideration within three business days after receiving the reports and photos, if any, from TRAMER. Each company submits its own responsibility evaluation result by electronic means to TRAMER. TRAMER establishes the necessary infrastructure for insurance companies to access the evaluation results electronically and in real-time.
11. The agreement reached by the insurance companies in accordance with the provisions written above is also binding for other companies that have not provided their own evaluations in the given time. If despite one of the relevant companies has submitted its responsibility evaluation to TRAMER in accordance with above provisions the other companies failed to submit in the given period, the responsibility ratios determined by the company that has submitted its evaluation are taken as basis.
12. If TRAMER finds out that an agreement was reached in the submitted evaluations, such determined responsibility ratios are notified to relevant insurance companies.
13. If TRAMER finds out in three business days following the submission in accordance with Article 9 above that the companies had different conclusions in their evaluations, the report and photos, if any, are submitted by TRAMER to Report Evaluation Commission (Commission) that is formed within TRAMER in accordance with article 17 of the circular. The Commission examines the report and photos, if any, and finally determines the responsibility ratios as 0%, 50%, and 100%. The result is submitted electronically to relevant companies by TRAMER.
14. The relevant insurance company will pay the compensation within eight business days after it receives responsibility ratios and completion of necessary documents in accordance with above articles, without prejudice to the provisions regarding the Car Insurance for Land Vehicles.
15. TRAMER establishes the infrastructure for beneficiaries to learn the status of their report examination applications online.
16. Traffic accident report will be prepared by traffic police in following cases.
a. In case of driving a motorized vehicle without driver’s license or driving a motorized vehicle with improper driver’s license,
b. If the driver’s age is small,
c. If the driver has consumed alcohol or there is any doubt about his/her mental health,
d. If one or more of the vehicles involved in the accident do(es) belong to public entities,
e. If any damage occurs in the properties of public entities,
f. If only the properties of third persons are damaged in a traffic accident,
g. If one or more of the vehicles involved in the accident do(es) not have traffic insurance,
h. If the traffic accident was concluded with death and/or physical injury.
17. Sufficient number of commissions are established within TRAMER upon a Resolution of the Board of Directors of the Association of Insurance and Reinsurance Companies of Türkiye (“Association”) in order to evaluate the faults in traffic accidents in accordance with the circular. Each commission consists of 3 members, one of whom would be the chairman. The regions, where the chairman and members of the commission will be authorized, are determined by the Board of Directors of the Association. The fees and other financial rights of the commission members are compensated by TRAMER. The commission takes decisions by majority. Commission members cannot abstain from voting. In the event of a tie in voting, the ratio, which was voted by the commission chairman, is taken as the basis for the decision. The commission has to conclude the assigned works within three business days.
18. The report, explanations for completing the report and model reports are provided free of charge by the insurance companies together with the policy.
19. The Association and TRAMER publishes the report and model reports that are completed on their websites.
20. The infrastructures required in accordance with the circular are prepared by relevant organizations to ensure that the system is put into force on April 01, 2008.
21. The circular becomes effective on April 01, 2008.
